Cruiser Care — Terms of Service

1. Who we are

2. The service

Cruiser Care provides tools to help you track vehicles, maintenance and logbook entries, read automotive articles and reference content, use AI-assisted vehicle guidance (subject to quotas and availability), optional Home Screen widgets, local reminders, and subscription features as described in the App. Features may change over time.

3. Eligibility and accounts

• You must be at least 13 years old (or the minimum age in your country) to use the App.
• You may sign in with Sign in with Apple as offered in the App.
• You are responsible for activity under your account and for maintaining device security.

4. Subscriptions and payments

• Pro or similar paid features are offered via Apple In-App Purchase, processed by Apple. Subscription management and billing are governed by Apple’s terms and your Apple ID settings.
• We use RevenueCat to manage entitlements. Entitlement status shown in the App is determined by RevenueCat / Apple’s records; separate fields in our database may not always reflect real-time purchase state.
• Auto-renewal: Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period through your Apple account.
• Free trials and pricing are displayed in the App and on the App Store; they may change.
• Refunds are handled according to Apple’s refund policies; we do not guarantee refunds outside those processes.

5. AI features — important disclaimer

The App may provide AI-generated responses (e.g. vehicle expert chat) using Firebase AI Logic and Google generative AI services.

• Not professional advice. AI output is for general information and convenience only. It is not a substitute for a qualified mechanic, engineer, or other professional. Do not rely on AI responses for safety-critical decisions.
• Accuracy. AI can be wrong, incomplete, or outdated. Always verify critical information (torque specs, procedures, recalls, fluid types, jack points, etc.) against your owner’s manual, factory service manual, or a licensed professional.
• Safety. Working on vehicles involves risk of injury or damage. Follow proper safety practices, use appropriate tools and PPE, and consult professionals when unsure.

6. Vehicle data, VIN, and registry

You may enter a VIN and other vehicle data. You represent that you have the right to provide that information.

We maintain a VIN registry to reduce duplicate VIN claims across accounts. You agree that we may store a normalized mapping between a VIN you register and your user account for this purpose, as described in our Privacy Policy.

7. User content and license

• Your content: You retain ownership of content you submit (e.g. vehicle notes, photos you upload), subject to the rights you grant us below.
• License to us: You grant Baillies Off Road CC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your content solely to operate, provide, improve, and secure the App and related services.
• Responsibility: You are responsible for your content and for not uploading unlawful, infringing, or harmful material.

8. Acceptable use

You agree not to:

• Violate applicable laws or third-party rights
• Attempt to hack, scrape, overload, or reverse engineer the service except where permitted by law
• Circumvent paywalls, quotas, or technical limits (including AI or article limits)
• Upload malware or misuse AI features to generate unlawful or harmful content
• Use the App in a way that endangers people or property

We may suspend or terminate access for violations.

9. Reference content and third-party information

Articles, knowledge base entries, OBD-II / DTC reference material, Remote Config–delivered specification data, and similar content are provided for general reference. Manufacturer specifications, procedures, and regulations change; verify critical information independently.

10. Intellectual property

The App, branding, and our content (excluding your user content) are owned by Baillies Off Road CC or our licensors. Except as allowed by these Terms or law, you may not copy, modify, or distribute them.

11. Third-party services

The App relies on third-party services (including Apple, Google Firebase, RevenueCat, and Google AI). Their availability, terms, and privacy practices are outside our full control. Your use of those services may be subject to their respective terms.

12. Disclaimers

THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• BAILLIES OFF ROAD CC AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR VEHICLE DAMAGE OR PERSONAL INJURY ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ANY CONTENT OR AI OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY.
• OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ZAR 2 000, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW (SUCH AS FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE IN SOME JURISDICTIONS).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

14. Indemnity

You will defend and indemnify Baillies Off Road CC and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your misuse of the App, or your violation of these Terms, to the extent permitted by law.

15. Termination

You may stop using the App at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the service. Provisions that by their nature should survive (disclaimers, limitations, indemnity, governing law) will survive.

Account deletion: Where the App offers account deletion, we will process it as described in our Privacy Policy, subject to technical and legal constraints.

16. Governing law and disputes

Governing law: the laws of the Republic of South Africa, excluding conflict-of-law rules.

Venue: the courts of the Republic of South Africa.

If you are a consumer in the EEA/UK, you may benefit from mandatory local consumer protections and may bring proceedings in your country of residence where required by law.

17. Apple-specific terms

If you access the App on an Apple device:

• These Terms are between you and Baillies Off Road CC, not Apple. Apple is not responsible for the App or its content, except as required by Apple’s App Store terms.
• Apple has no obligation to provide support for the App.
• If the App fails to conform to an applicable warranty, you may notify Apple; to the extent permitted by Apple’s policies, Apple may refund the purchase price; Apple will have no other warranty obligation.
• Apple and its subsidiaries are third-party beneficiaries of these Terms regarding your license to use the App on Apple devices, and may enforce those provisions.

18. Changes to these Terms

We may modify these Terms. We will post the updated Terms with a new “Last updated” date. Continued use after the effective date constitutes acceptance of the revised Terms, except where stricter notice is required by law.

20. Entire agreement

These Terms, together with our Privacy Policy and any additional terms presented in the App (e.g. for specific features), constitute the entire agreement between you and Baillies Off Road CC regarding the App.
